Waiver

You have agreed to purchase a membership at a facility that allows you access only during specific times. As such, you are aware that there will be no supervision or assistance. You are also aware that if you are injured, become unconscious, suffer a stroke or heart attack, that there will likely be no one to respond to your emergency and this facility has no duty to provide assistance to you. Even though this facility is equipped with surveillance cameras, it is likely that should you require immediate assistance, none will be provided. We HIGHLY recommend that you have a workout partner accompany you while at Superior Fitness Center, but it is entirely up to you. Initial______ Because physical exercise can be strenuous and subject to risk of serious injury, Superior Fitness urges you to obtain a physical examination from a doctor before using any exercise equipment or participating in any exercise activity. You agree that if you engage in any physical exercise or activity, or use any Superior Fitness amenity on the premises or off premises including a sponsored club event, you do so entirely at your own risk. You agree that you are voluntarily participating in the use of this facility and assume all risks of injury, illness, or death. We are also not responsible for any loss of your personal property. Initial______ This waiver and release of liability includes, without limitation, all injuries which may occur, regardless of negligence, as a result of; (a) your use of all amenities and equipment in the facility and your participation in any activity, class, program, personal training or instruction, (b) the sudden and unforeseen malfunctioning of any equipment, (c) any dietary recommendations and (d) your slipping and or falling while on the premises, including adjacent sidewalks and parking areas. Initial______ You acknowledge that you have carefully read this “waiver and release” and fully understand that it is a release of liability. You expressly agree to release and discharge Superior Fitness Center, and all affiliates, agents, representatives, successors, or assigns, from any and all claims or causes of action. You agree to voluntarily give up or waive any right that you may otherwise have to bring a legal action against Superior Fitness Center for negligence, personal injury or property damage. Initial______ Under no circumstances shall Superior Fitness Center, our subsidiaries or independent contractors be liable for any direct, indirect, punitive, incidental, special or consequential damages that result from the use of or inability to use Superior Fitness Center’s cardio equipment, free weights, machines or any other fitness tools. Initial _______Participation and use of services and equipment involves the risk of injury to you, whether you or someone else causes it. Specific risks range in severity from minor injuries to major injuries, such as catastrophic injuries including death. In consideration of your participation in the activities or program offered by Superior Fitness Center, you understand and voluntarily accept this risk and agree that Superior Fitness Center, its directors, volunteers, agents, owners, founder and independent contractors will not be liable for any injury, including, without limitation, personal, bodily, or mental injury, economic loss or any damage to you resulting from the negligence of Superior Fitness or anyone on Superior Fitness Center’s behalf or anyone else whether related to participation in the Fitness Program or not. You understand and acknowledge that Superior Fitness is providing recreational services and may not be held liable for defective products. Initial ________ You understand that you may be photographed, videotaped, or otherwise recorded, and you agree on behalf of yourself that Superior Fitness Center may use your name and likeness (in any form and without regard to distortions of character, form or color, or any other alteration) in photographs, videotapes, audiotapes, and other media.

Initial ________ You understand that under no circumstance are you allowed to park in Wash and Fun’s parking lot. Doing so will result in your vehicle being towed at your own expense and your membership at Superior Fitness Center will be immediately terminated without a refund for the month of termination.

By signing below, you agree to the terms of this Release of Liability and Assumption of Risk on behalf of yourself. You also agree to defend and indemnify Superior Fitness Center from and against any claims, demands, causes of actions or lawsuits for injuries or other damages whether or not caused by the negligence or other conduct of Superior Fitness Center. There will be an automatic renewal of membership if cancellation notification is not given!
